DEBTOR BANKRUPTCY PRACTICE

Ask a Bankruptcy attorney the purpose of bankruptcy and depending on his or her orientation you might hear him or her say to "stop the calls," or "discharge debts," or "get debt relief," or "reorganize debts." These are all things that should happen in a bankruptcy case (and if they will not Bankruptcy may not be the best tool), but they are not, in themselves, the overriding goal.

We think that the overriding goal of bankruptcy is to get a fresh start. Our job is to help you reach that goal. We seek to use the tools that the law provides, which includes, but is not limited to, Chapters 7, 11 and 13 of the Bankruptcy Code, as applied to your particular circumstances, to get you to where you can start fresh.

HOW TO USE THIS WEBSITE. This website is not a substitute for legal advice. See our disclaimer. It is provided for general informational purposes. In constructing it we try to answer many of the questions we expect that you have (although there is no way we can answer them all on this site - that's why we offer a free consultation). We recommend that you start with the FAQs page. It should provide you a good overall view. It will link out for certain topics if you want more information. The direct links to the different Chapters are a convenience to those who are looking for specific information about that Chapter. You should recognize that Courts are still wrestling with the 2005 Amendments to the Bankruptcy Code and therefore, the case law is evolving. At any given time this site may not reflect the latest developments.

For additional information or questions, email us at katzlawoffice , or call (412-281-1015) or fax (412-325-1532).

NOTE. You have the right to represent yourself in Bankruptcy. See "Disclosures" (which are statutorily required to be provided to consumer debtors) and which, among other things, expressly advises you of this right. Although you have that right, you should also be aware that it is dangerous to get into a legal proceeding (which a bankruptcy case most surely is), without legal representation. Consider, for example, the U.S. Courts website (at http://www.uscourts.gov/bankruptcycourts/prose.html) which points out that "Bankruptcy has long-term financial and legal consequences — hiring a competent attorney is strongly recommended." While we hope you consider us for representation (if you elect to be represented), we are not your only choice. If you cannot afford an attorney - call your local bar association (in Allegheny County that would be the ACBA Lawyer Referral Service at (412) 261-5555) to see if you're eligible for some form of legal aid.
